PACE Organizer Contract v1.03 – 10.4.2021
1. General
PACE Organizer Contract is an agreement between PACE Sport Ltd and the organization entity in response of the activities. PACE Sport Ltd offers the service under the brand name PACE, and PACE Sport (here “PACE”, “PACE Sport”, “we” or “us”).

PACE agrees to provide registration and related services for the organizer according to terms and conditions given in this contract.
2. Services
Our web-based system provides you with the capability to display your offering in our system and collect fees from customers to buy your service or product. The platform is available through our site www.pace.sport.
3. Intellectual property rights
Triathlon Factory is the sole legal owner of the service and has all the proprietary rights for the source code, intellectual property, and trademarks. This agreement does not transfer any of the property rights. Any illegal use of the property rights is considered as a criminal act.
4. Data collection
To be able to provide the service we collect data:
-Individuals using the service and registering for events. Stored information includes name, birthdate, gender, email address, phone number and other information required for the service.
-From organizers we collect information that enables us to identify legal entity responsible for providing their offering. In case of providing incorrect or misleading information you agree to indemnify any fees or charges related to the incorrect information.
-We collect data on events organized and on individuals attending the events.
We agree to take reasonable actions to protect the data. Data is stored according to European Union standards for storing personal information. Organizer has responsibility to store and handle collected information according to local privacy laws.
5. Content by organizer
Organizer is responsible of all the materials they provide into the service and must have adequate intellectual property rights for them.
Organizer is responsible to keep their offering information up-to-date, so that customers can have clear understanding of what organizer is offering, when and for what price.
6. Cost of service
There is no fixed or starting fees for the service. Sales processing fee is 1 € + 4 % of the checkout total (VAT 0%). Fee is calculated per transaction. Value added tax is charged according to Finnish tax laws.
PACE retains the right to change pricing for the service with 1-month notice period.
7. Payment service
Payment services are provided by third-party operators. Organizer may need to do a contract with a payment service provider to be able to use their payment service. PACE is not responsible of the services offered by third-party operators.
8. Sales Agent
PACE may act as a sales agent for the services sold in PACE platform. In case where PACE act as a sales agent on behalf of the Organizer, PACE collects payments from customers and account to Organizer on monthly periods.
9. Delivery of offered service
Organizer is responsible of delivering the product they have sold in PACE platform. PACE provides customers with a ticket of the service. The ticket is considered as a legal right for the customer towards the product organizer is offering.
10. Customer service
Organizer is responsible of answering customer’s questions regarding their offering. PACE doesn’t take any role in customer support regarding the offering of organizer.
PACE will provide customer service regarding the event and registration platform.
11. Termination
Organizer may at any point discontinue using the service.
PACE retains the right to terminate this contract with 1-month notice period. PACE Sport may deactivate, suspend or terminate use of the service in case of material breach, misuse of the service or using the service in fraudulent or improper manner.
12. Liability
PACE provides the service “As-is” and “As-available”. PACE is not responsible of any availability or functionality issues. PACE is not responsible of any damages or losses occurring for the organizer.
13. Applied Law
This agreement is governed by Finnish laws. All disputes regarding this agreement shall be addressed in court of Helsinki.
14. Acceptance of the agreement
Organizer agrees to these terms by using any of PACE services.
